Your starting point

For a West Virginia car wash sale, establish whether the wash uses a municipal sewer or a registered discharge and retrieve the authorization that actually covers it. Direct-discharge facilities need particular attention to permit conditions, maintenance records and the transfer of responsibility. Pair that review with the site’s flood history and practical customer access.

Start with the current registration and its conditions

DEP’s current index links car wash general permit WV0078743, effective July 13, 2022 through June 12, 2027. It covers specified treated wash/rinse discharges, subject to registration and conditions. The general permit excludes discharges into trout waters; the agency may require an individual permit. A downloaded general document is not proof that this wash has coverage.

Retrieve the registration approval, site-specific conditions, discharge location and correspondence, and compare them with the equipment and activities on site. Identify any changed bays, treatment process or chemicals. If the wash sends wastewater to a municipal sewer, establish that receiving arrangement instead of assuming the direct-discharge program is its authorization.

Use the final permit linked by the current agency index. Search engines can surface older documents, and an old filename can remain indexed after its address stops working. Keep the effective dates and the facility registration together in the buyer file.

Show how treatment and exception conditions are managed

The permit includes additional carbon filtration in agency-determined karst areas, maintenance records and conditions for handling solids. It also addresses connection to an available sewer able to receive the wastewater for covered fee-generating operations, including prior written receiving-authority permission. The actual site conditions matter; nearby sewer infrastructure alone does not establish an accepted connection.

West Virginia treatment continuity file
RecordWhy a buyer needs it
Approved treatment design and site conditionsEstablishes what the facility is authorized to operate
Maintenance logs and submitted reportsShows recurring work, missed service and reporting ownership
Residue removal and contractor recordsExplains disposal arrangements and recurring cost
Agency and utility correspondenceIdentifies unresolved conditions or a potential connection project

If a future sewer connection has been discussed, distinguish an informal possibility from a documented requirement and feasible design. Identify capacity, connection scope, cost responsibility and the agency/utility decisions still needed. Do not price it as a completed improvement or omit it from the continuity discussion.

Resolve the transfer agreement before assuming liability is settled

DEP’s currently linked transfer form carries a January 2018 revision and calls for an agreement identifying when responsibility, coverage and liability move between the parties. It also distinguishes changes in the permitted activity or discharge from the ownership transfer itself. Use current agency instructions for the facility and have counsel review the allocation language.

Prepare the current registration number, legal names, operating entity, proposed closing date and any known environmental or reporting issues. A purchase agreement and a permit form may address different responsibilities. Neither party should assume that a general indemnity resolves the agency’s requirements or the buyer’s operating authority.

Illustrative issue: the buyer plans to add a second automatic bay immediately after buying the existing wash. Treat the ownership submission and the proposed operational change as separate workstreams. Establish who operates and reports during the interim and which approvals are needed before the new activity begins.

Review the approach road alongside flood and closure history

NOAA’s West Virginia summary describes varied conditions across rugged terrain and identifies flooding as a significant regional hazard. This warrants a parcel and operating-history review; it does not establish the exposure of every valley location. Keep property flood information, insurance terms, drainage records and actual interruption dates distinct.

WVDOT’s map resources include AADT and road information. Match a dated count to the approach that serves the wash. A busy road across a river, behind a median or beyond an inconvenient interchange may offer less usable access than a lower-count road at the driveway.

Check customer turns, queue storage, bridge or route limitations affecting the vehicles served, and access during documented disruptions. Compare receipts and open hours before, during and after an interruption. Do not assume that all traffic diverted past the property converted into customers, or that temporary detour receipts will persist.

Prioritize the item that could interrupt the buyer’s operation

Bring together the registration file, treatment responsibilities, unresolved correspondence and a short explanation of historical closures. Then reconcile recurring operating costs with the work the owner personally performs. The first sale discussion becomes more useful when it identifies what can transfer smoothly and what needs agency, utility or professional clarification.

Owner questions

Does the West Virginia general car wash permit prove my wash is covered?

No. Match the current permit to the facility registration, approval and site-specific conditions. A municipal-sewer operation also needs review of its own receiving arrangement.

Can a buyer change the wash while transferring its West Virginia permit?

Do not treat a transfer as approval for new activities or discharge changes. Review both workstreams with DEP using the actual facility record and proposed changes.
